Pioneering Change in the IVF Industry - The Legal Battle for ICSI Classification
In the dynamic world of the IVF industry, the classification of equipment can have significant implications. At Shivani Scientific, we undertook a remarkable nine-year legal battle with the Department of Customs, Government of India, to reclassify the ICSI Machine as a Medical Device. Intra Cytoplasmic Sperm Injection (ICSI) has become a cornerstone technique in infertility management, and the microscope and micro-manipulator used are invaluable instruments in any IVF lab.
Since the inception of ICSI in India in 1997, it was classified as Laboratory Equipment. However, in 2011, we decided to challenge this classification for the greater good of the entire IVF community in India. This decision led to a prolonged legal journey that culminated in a court order declaring ICSI as medical equipment.
While this endeavor spanned nine years and came at considerable cost, the benefits were undeniably worth the struggle. The court's decision has resulted in substantial savings for Indian IVF clinics, reducing custom duty and GST burdens. Today, ICSI is charged with a reduced 12% GST rate, a significant victory for the entire IVF community.
